BP Gift Card Fleet Fuel Card Investigation

The Consumer Fraud Lawyers at Keefe Law Firm are investigating claims regarding the use of gift cards and fleet fuel cards sold and distributed by BP for use at BP service stations throughout the country.
Consumers purchase the gift cards for friends and family in denominations of $5 to $100 dollars; businesses purchase the fleet fuel cards the same way.  Customers pay cash for these cards.
However, our investigation revealed that when purchasing gasoline with one of these cards, customers are actually charged the “credit” price for the fuel, despite the fact that the cards are purchased with cash.  In fact, the first sentence of BP’s Gift Card Terms and Conditions reads, “Treat this card like cash.”  Despite this, BP has unilaterally decided to treat any purchases made with these cards as “credit” purchases.  By treating these cards like credit purchases, BP may have violated New Jersey’s Consumer Fraud Act.
